Perskie Case to be Heard Again

On Friday, January 12th, at 8 P.M., the Avalon Zoning Board of Adjustment will again hear the petition of the Perskie Estate for permission to erect a duplex dwelling at 3rd St. and the Beach. By Cate Watson For many years the citizens of Southern New Jersey have felt that tax contributions were not fairly distributed throughout the state. The business people of Cape May County have felt cheated. The tourist industry, which is the second largest in the state, contributes a substantial amount to the state yet derives little benefit. Because most state aid is calculated using a population formula, resort areas feel deprived because of low yearly populations and high tax contributions. As a result of numerous calls by business and Civic leaders, Assemblyman James R. Hurley (R-Cumberland-Cape May) is working on a bill which will furnish to the seasonal industries the amount being contributed to the gross revenues of the state. Under Hurley Bill A-10, the Director of taxation, Sidney Glaser, testified before the Taxation Committee on this bill requiring the Division to supply this Tax data. Glaser agreed that the counties of South Jersey had a right to know what the tourism industry is contributing. Hurley seemed, pleased with Glaser’s statements saying this is the ‘‘first time he expressed a willingness” to cooperate with the Taxation Committee. At the hearing, the Taxation Director said that the tax data by county could be furnished under the present structure, but the division would require substantial changes in computer procedures to supply the tax revenues by municipalities. The setup of the computer has been holding this bill up for several years and is the reason why this information is not known. The Taxation Committee will meet again next week when Director Glaser is expected to tell the committee how the Division will provide the tax information and what steps are needed to change the computer coding. When it is known what the seasonal industries contribute to the state coffers, then the state aid formulae can be readjusted to consider not only population but also the percentage of contributions. Hurley said, "Contributions at the county and municipal level should be given their proper weight when it becomes time to divide up the goodies.” If this bill gets adopted, it could mean more state funds for Cape May County. This appeal has been fought for over 2 years by Dr. Robert Barndt, a Devon veterinarian who ownes an expensive single family home next to the lot in question. The area is zoned single family residential. The original application was turned down by the Avalon Zoning Board, which was then sued by the late Marvin Perskie, owner of the lot. The decision was overruled by a Superior Court Judge, and that decision was overturned by the Appellate Court. The State Supreme Court refused to reverse the Appellate Court’s decision and sent the case back to the Avalon Zoning Board.
