Petroleum Council Says TRENTON - Vje New Jersey Petroleum Council last pointed out that as a result of a federal Department of Energy order some five percent of state gasoline supplies are directly controlled by an agency of New Jersey government. The order was issued to take effect June 1 through Sept. 30. 1979 The federal order stipulates that five percent of supplies be available for use in the states “setaside program so that the Energy Department headed by Joel R Jacobson can allocate the gasoline in accordance with government guidelines. Prior to the latest order, the “set-aside" percentage had been three percent. The “set-aside" program, said Leonard H. Ruppert, executive director of the oil company trade association, is little known to the public. It was created during the first oil embargo to insure sufficient supplies for those suffering hardships during emergency periods. » “What this means." said Ruppert. “is that a company announced gasoline allocation figure should be increased by five percent to account for the 'setaside' portion. Thus, if a company announces it will provide its dealers with a figure of say 85% of last year's usage, it is actually supplying the New Jersey market a total of 90% or more, but has no control over usage of five percent of that total. "As to who gets what.” he continued, "those, priorities are decided as a matter of public policy by agencies of government. not by the individual companies. Often one company’s gasoline is shifted by government decision to a competitor." Under government allocation rules, companies must fill all requests from certain customers, such as agricultural police, emergency and municipal users. Higher shares than that provided other customers must also go to publit transport operations. In addition, refiners must take on new customers assigned to them by the DOE. These regulations, in addition to the "set-aside" rule, result in companies not being able to supply full requirements of their regular customers, even though individual refiners may actually be delivering the same amount of gasoline to all users that they did last year.
