License Roadblock Removed

TRENTON - An often expensive and time consuming obstacle has been removed from the path of New Jersey motorists who are attempting to have their licenses restored following the legal suspension period imposed by a court or the Division of Motor Vehicles.

According to the provisions of a bill recently signed by Governor Byrne (S-488) it will be no longer necessary for the applicant for reinstatement to file proof of financial responsibility (commonly known as an SR-22) under the Motor Vehicle Security Responsibiltiy Law.

In signing the bill, the Governor noted that it is not necessary under New Jersey’s system of compulsory automobile insurance and the no-fault law to continue a system which, according to the Dvision of Motor Vehicles, "requires unnecessary administrative paper work and in some cases unnecessary delay.” According to DMV Assistant Director Judith H. Wizmur. in cases where suspensions may be for a short period of time (e.g. 60 days) compliance with the submission of a Security Responsiblitity 22 form can run past the suspension period causing unnecessary hardship and delay for the motorist.

The change in the law has no affect on the $20 restoration fee required at the time the license is restored or on other fees that my be imposed such as fees for attending state operated driver imvement schools and the

Ms. Wizmur, who heads Safety and Driver Improvement for the Division and Assistant Director Seymour Blaustein, who is in charge of Driver Responsibility, said that New Jersey suspends the driving privileges of about 200,000 people a year out of a total licensed driver population of nearly 5 million. Of these, only about 30,000 formerly required proof of security responsibility under the terms of the old

law. These included individuals found quilty of driving while under the influence of liquor or drugs, reckless driving, leaving the scene of an accident and homicide arising out of the operation of a motor vehicle. Other causes were failing to satisfy a judgment for damages as a result of a motor vehicle accident or failure to maintain proof of

financial responsibility while paying a judgment in installments. The new law is effective immediately. Motorists whose period of suspension ‘expired August 10, 1979 or mereafter and who have met all other motor vehicle requirements may be restored without filing the previously mandated SR-22 forms.
