Prosecutor Defends Code
STONE HARBOR - The new State Penal Code, despite much criticism, ha* 'enhanced'' law enforcement in the State by giving authorities ‘additional tools'' in dealing with crime. Cape May County Prosecutor Donald Charles asserted Monday in comments before a meeting of the Stone Harbor Chamber ot Commerce. Charles also told the Harbor Chamber that notwithstanding opinions expressed to the contraty. law enforcement officials in the State in general and in Cape May County in particular were "wrell prepared - extremely well prepared f r the Job ahead of tiicn when the new penal o> went into effect at .!:i»i a.m. this past September 1. Favorable Terms Charles made his comments before the usual 100-plus turnout that the Stone Harbor Chamber regular draws for its "offsejbon" monthly meetings. He w spoke of the code in generally favorable terms, admitting that his own knowledge of it <as well as early every one else's at fNs’earlv state* is not as t.imiliar ' as it would and should lx* " He primarily iddressed two criticisms t tat have fmiuently been leveled at the new penal code during the pd^t several months that it was enacted in haste, and that officials were ill-prepared 1 to administer it. Charles implied that some of the misunderstanding has been generated due to the undue attention given to the sex new code.
The County Prosecutor noted that the law had been ten years in preparation, with’ all interested parties having had the opportunity to present their ' inDuts” to the state legislature: prosecutors, all agencies involved with law enforcement. public advocates. and citizen groups. And pointing to the educational program directed by the state attorney general over the c ourte of a year prior to the Ijw taking effect September 1, Charles termed tU changeover to the new code a "smooth transition... (there was) no mass confusion..." He said that all ranking members of police departments were given three eight-hour days of classes of introduction tothe new code, and that all patrolmen attended a single eight hour class, linger Terms The Cape May County Prosecutor, who has held his post for three years, gave special praise to those aspects of the law which encourage the increased length of imprisonment for those committing crimes in the two most serious classes of offense In such instances, the new code has inaugraled what Charles called the "presumption of imprisonment;" that is. that the code assumes a prison term will be given if a person is found guilty of specific offenses. The sentencing judge is empowered to vary the sentence from the expected norm, but he or she must give reason why such variation is appropriate.

Church Paul COURT HOUSE - Sunday. September 30. the First ’ United Methodist Church of Cape May Court House honored Mr. Paul M. Scull with the presentation of a plaque for 68 years of serving the Lord through many official capacities of the Church. Starting at the age of 1A when he was appointed Assistant Sec'y of the Sunday School he has served as Superintendent of the Sunday School, teacher of the men's Bible Class. Church Treasurer. Church Trustee and member of the Official Board for over 50 years and sang in choir for more than 40 years. He also taught an adult Bible class in the Wildwood Crest Community Church fpr 10 years. Honors Scull May Court House is celebrating its 150th year in 1979. In researching the records of its history for bits of historical information given each Sunday during 1979 as an "Historical Moment" in the morning worship service it was found that Paul M. Sc hull is the oldest ritember in continuous attendance in fbe church, having started attending Sunday School in May 1903. And Charles praised a related feature of the new code which permits a judge to set a minimum period of time a person must serve in prison before coming up for parole Both these features. Charles opined, mitigate against too lenient sentencing. and answer the oft-heard public criticism Viat hardened criminals are released from prison toosoon.
