VILLAS - Contractor James Wagner is scheduled to come before the Lower Township Zoning Board of Adjustment next Tuesday for a hardship variance to build a single family dwelling on an undersited lot in Town Bank. The Racetrack Dr. parcel (Block 542 Lots 1003 and 1004) is owned by Toll Realtor, and Wagner is seeking a variance to build on a 40 x 100 lot, which has less than the 5,000 sq. ft. and 50 ft. frontage minimums required in the toning ordinance. Wagner has been pushing for some time to have township officials amend the zoning ordinance to allow construction on 40 x 100 ft. lots so that variances aren’t necessary. Until several months ago, the township building official was granting permits for undersized lots providing set-back was met, despite the ordinance to the con-

trary.
