Utility Can Wait Out Coal Strike

TRENTON - Labor and Industry Commissioner John J. Horn announced today that individuals receiving extended employment compensation benefits are now required to meet tougher eligibility conditions, which became effective April 1. They have been instituted as the result of federal legislation which was enacted in December 1980, Horn said. NEW JERSEY AND all other staes were required to enact similar legislation in order to insure that employers wouldn’t lose tax credits under the Federal Unemployment

Tax Act.

"If New Jersey failed to enact these changes." Horn said. "New Jersey employers could have lot up to $500 million annually in federal tax credits." Arthur J. O'Neal Jr., assistant commissioner for Income Security, explained that the changes will require that individuals receiving extended benefits after March 31, must make a systematic and sustained active search for work. IN ADDITION, such individuals who do not have good prospects of returning to work must be prepared to accept suitable work which would be within the individual's capability. The individuals must be prepared to accept work which pays higher than the individual’s weekly unemployment benefit amount and exceeds the

national or state minimum wage. Individuals who fail to seek work or refuse suitable work will be disqualifid Indefinitely until they return to work for at least four weeks and earn four times their weekly ^

benefit rate.

INDIVIDUALS WHO have been disqualified for regular benefits for misconduct discharges or refusal of suitable work could qualify for extended benefits only if they return to work after the date of the original disqualification. The extended benfits program provides for additional unemployment insurance benefits to individuals during periods of high unemployment. Benefits are payable up to a maximum of 50 per cent of the individual’s entitlement under the regular claim. The program is funded on a 50/50 basis by the federal government and the state. There are approximately 35,000 individuals currently receiving benefits under the extended benefits program. HORN EMPHASIZED that these changes are a result of federally mandated requirements and that if New Jersey doesn’t meet the requirements, severe fiscal penalties could be imposed. Unemployment In-, surance Director Joseph S. Viviani indicated that all extended benefit claimants will be receiving informational material when they report to claim offices during the next several weeks.
