Riparian Right ‘Yes* Vote Urged

TUCKAHOE Upper Township Mayor Leonard Migltaccio has thrown his weight behind a proposed constitutional amendment to limit the state’s claim'to waterfront property or property once flowed by tidal waters "This is hut one more rip-off of the property owners of New Jersey by Governor Byrne and his bureaucrats," Mayor? Migliaccio said "Under •the present pIBas of Byrne ■and his DEP. the state could conceivably claim property over which tidal waters once flowed as long as 300 years ago. and this is not just ocean and bayfront property, but. riverfront property as well. "BY USlftG OLD and quite possibly inaccurate maps, the state could lay claim to property that owners have- been paying taxes on for generations. Here in Upper Township, areas along the bay, along the Tuckahoe River and the

erittre town of Slrathmere could Ik? affected. Most, if not all, of Ocean City and S^a Isle City would likely Ik* subject to such a state claim " The State ol New Jersey is legally required to assert claims to any land where riparian ownership is in Klispute The State Assembly and Senate this summer voted to approve a constitutional amendment that would pul a time limit on the state's right to make such claims on property The referendum on . November’s ballot would limit the DEP to one year to pursue any historical riparian claim "THE STATE HAS not starts^ on Cape May County yet," Migliaccio. said, "as they have heed; too busy with their land grab' in Atlantic County. I urge all citizens, regardless of party affiliation, to vote 'yes' on the constitutional amendment," the Mayor said.
