StONE HARBOR - James P WHdener, a registered land surveyor and president-elect of the State .Surveyors’ Society, addressing the October meeting of the Chamber of Commerce* emphasised that potentially thousands of people could be victimized, even on the mainland, by the ftiparian Rights.Act. Riparian pertains to anything connected with or adjacent to the banks of a body of water; a riparian owner is one who owns the banks, and a riparian right is the legal right to control and use water by virtue of ownership of the banks Weidener explained. FOR 300 YEARS New Jersey, citizens have|been encouraged to develop, improve and protect riparian lands, defined as thos© below the mean high water level. The State Constitution required that the, state claim land from private or public owners, if that land can be prcved through past recorded history to be riparian. The current owners must lease back or purchase their own property from the state at current market values. Until 1980, a taxpaying property owner was Entitled to free Ownership, and quiet enjoyment of such property; now the state is employing every effort to reclaim this land from its legal owners, the speaker noted. 1 THE STATE MICE attempted to claim vlLOOO acres of the Hackensack Meadowlands, including virtually the entire town of Kearny with a population .in excess of 37,000 people,”' Weidener said. “Claims are quietly

made by filing maps at the county court house, and individuals may not even be aware of these claims until they wish to sell, divide or develop their land,’’ Weidener warned. "If the owner wants to contest the claim his only recourse is to ttop courts, an extremely expansive and time consuming procedure." THE SPEAKER URGED

his listeners to write or phone every New Jersey land owner they know to vote "yES’' to approve the amendment to Article Vll! of the Constitution. This amendment provides that if the State does not, within one year, present all claims on lands that have been dry for at least 40 years, these claims are barred.

Migliaccio For Hurley

TUCKAHOE - Upper Townshjp Mayor Leonard Migliaccio has voiced vigorous support for State Senate Candidate James R. Hurley. “Hurley, during his many years in The State Assembly, has shown he had a dedicated interest in thq district, and Upper Township,” Migliaccio said. "His continued support of Upper Township’s position on the^grossk receipts tax, and his con-

tinued cooperation with me and the Township Committee has helped keep Upper Township’s taxes low.’’ "As minority leader in The State Assembly he worked hard to block the continued attempts of the Democrats to*take away Upper, Township’s tax base';" . the mayor continued, "and as a State Senator, Hurley will be able to give Upper Township an even stronger voice in Trenton."
