Dept, of Health has ordered the SPCA here to refrain from using its antiquated gas chamber to destroy animals tyecause the device is so ill equipped it actnally burns the lungs of dogs and cats before they can die from carbon monoxide poisoning. That the SPCA's Dennis Kelly was us-ing-the device came to light two weeks ago wherf Dave Masterson of the Associated Humane Societies paid an unannounced visit to the pound in S. Cold Spring and found dead cats outside the cinder block chamber and a dying kitten inside. ; . HE SUBSEQUENTLY fought charges of cruelty in municipal court against the SPCA. Kelly and the Corporation he trades under as the abimal control officer, for most of the municipalities in the county; and blocked further use of the chamber via a Superior Court restraining’ order. Masteron also asked the township governing body for permission to act as their liaison so he could make periodic unannounced checks on the pound and report back to the Committee. At Monday night's meeting, however, the Committee on the advice of counsel, decided against Masteron's offer-^at least while litigation is pending. ^ j

According to Ed Michaud, the 700 lb. idol was smuggfed aboard the sailing vessel in Shanghai during the Boxer Rebellion and concealed beneath tons of ballast in the ship's bottom. MICHAUD AND HIS partner Michael Kenney, who are currently seeking backing for an expensive device to facilitate' sand pumping operations around the ship all but covered by sand off the 17th St. beach, say information about the Oriental religious relic is contained in the personal records of the ship's captain. The ship, perhaps the most famous 20th century shipwreck along the Jersey . Coast, went aground here during a winter storm enroute from Japan to Nejv York.

Sandman ysV Bank LOWER.TWP. - According to published account, property on which former Cong. Charles Sandman is seeking zoning changes to make his land mdre profitable is involved in a bank foreclosure actibn. Sandman reportedly u$ed eight building lots near his Erma Park home as partial.collateral on a $1.9 million mortgage for his Two Mile Inn restaurant. When he allegedly missed a mortgage payment, the entire mortgage 'became due. FIRST PEOPLES BANK began foreclosure proceedings against Sandman several months ago, but Sandman has, in turh, filed suit against the bank's attorney, alleging that Joseph Tpso told a developer about the pending foreclosure thereby queering a $3 million condominium deal. Sandman has been before Lower Tow^hlp officials seeking a zoning changeMo allow for condominium construction in the Marine Development zone where his restaurant is located. He is also seeking smaller lot sizes in the Ertna Park development, contending the old zoning ordinance under whichihis subdivision was approved didn't require lots as large as under the new ordihance. IN HIS SUIT against attorney Tuso, Sandman alleges the bank had instructed ' Tuso to release.the eight lots^o Sandman could convey clear tjtle to buyers and use the money for the bank mortgag^but that Tuso delayed and told the buyer's attorney Sandman couldn’t provide clear titl* As for the allegation concerning the condominium dea> Sandman asserts that by informing the developer about the foreclosure. Tuso in effect was signaling the developer that if he waited, he could obtain the property for less. Sandman, wno has publicly said Two Mile couldn't reopen next season without the condominium approval, was planning to use the mohey from the condominium sale to pay off the mortgage.
