DUE TO TECHNICAL amendments, S-112 will go back to the Senate to be voted on once again. Passage is expected in thp Senate and it then will sent to Governor Keah who is expected to sign y into law. The opponents of the Death Penalty Bill argued that the measure will make the Court process of convicting a murderer much more costly. The bill passed the Assembly by a vote of 54-19.

TRENTON - The legislature must take immediate action to protect innocent homeowners who were unaware that their property is in a tidal region and belongs to the state, says Sen. James R. Hurley Maps recently completed N by the state shqwihat tens of thousands of homes and businesses flong the coastline and r^ar rivers are in tidar areas, technically making them state property. A CONSTITUTIONAL amendment approved by voters last November gave the state one year to determine all land that has been washed by tidal water in the past 40 years and claim title to these 1 hundreds of thousands of acres. Many homeowners in the affected ar^as did not know that their land is in a tidal region and have been given clear title to the property, Hurley said. IT IS UNFAIR to punish these people and force them to pay a fee to the state based on the current market value of the land, he added The mapping of riparian land was far more extensive Than he had anticipatbd, Hurley went on. Land that has been developed for decades has been designated tideland. RESIDENTS, he (said, are “understandably\ confused and alarmed’’, by these maps. Before the state begins making any claims on the land, the legislature must establish fair guidelines to protect homeowners. Hurley declared. THOMAS Kean has assured residents that the state “has no intention of seizing lifelong homes ..’’ And the governor has called for a cohstitutional amendment to be placed on the November ballot that would give^he Legislature authority^-t^Otablish a price below fair market value for buying back tidal lands from the state. THE AMENDMENT is a

necessary step to spare owners of tidal lands undue financial hardship and deserves the support of the entire legislature. Hurley said. The Cape MayCumberland Senator is drafting legislation to further protect homeowners from paying exhorbitant fees to the state for tidal lands they have paid taxes on for years. OWNERS OF land in regions where there is no doubt the tides flowed sometime during the past 40 years would receive credit for all property taxes they paid on the land.

This credit would be deducted from the price the state would charge a landowner to buy back the disputed property. Another proposal deserving of consideration, Hurley said, would subsantiaily reduce the cost of buying back tideland by establishing the land value at what it was worth when owners began paying property taxes on it. Hurley said he is confident a fair solution can be found so homeowners will be assured that the land they purchased and paid taxes on for years rightfully belongs to them.
