City Changes Zone to Block Wawa Store
by Jacob Schaad Jr. CAPE MAY - After an hour and 15 minute public hearing, city council Monday night unanimously approved a zoning ordinance change that would block construction of a proposed Wawa convenience food market on Pittsburgh Ave. Local attorney Fred Schmidt, who represents both the property owner and the prospective buyer, •wid after the meeting the
city’s decision will be appealed in a court action. MAYOR Arthur Blomkvest voted for the change, saying he feared more traffic problems on the already busy Pittsburgh Ave. He noted that sometime in the next decade with the help of federal moneys for beach restoration, the beaches from Convention Hall to Poverty Beach will be open to the public.

"Can you imagine the amount of traffic we’re going to have on Pittsburgh Ave. then?’’ he asked. "We’re not going to be able to handle it.” COUNCILMEN Adrian Capehart and Harry Gilbert echoed his sentiments. Gilbert said the people of the city elected the council to represent them the way they want to be represented and he is following their wishes. Schmidt spoke at length before the decision, contending the council was changing the rules in the middle of the ballgame. He craallenged the authenticity of some of the signatures on a petition which more than 350 people were said to have signed and which was presented to the council. The lawyer argued that only 20 per cent of those signatures fell on pages that listed the reasons for the petition. • BE CAREFUL. Study the matter. Get expert advice," Schmidt implored the council. "If later you decide you made a mistake, it probably will be too late " Later, he added: “I’m not here as a hired gun. I’m a human being also. I could not live with myself if I didn’t believe the way I did." Schmidt represents PRB Enterprises, which wants to build the store, and Cape May Greene which wants to sell the property to PRB.
The local planning board has granted subdivision for the property, but denied a site plan. A new application for a site plan, which Schmidt says will meet the planning board's requirements, will be filed on Sept. 2. The new ordinance, however, changes the zone from commercial to residential. Unless the courts reverse the city’s decision, all the other action is now academic. THE BULK of the opposition has come from residents of nearby Village .Greene — a- Cape May Greene housing development — although signatures on the petition are those of residents in other areas of the city. About 50 residents attended the Monday night hearing and several expressed their views. The hearing, compared to those held earlier,' was surprisingly calm. Robert Kummeth, a Virginia Ave. resident, said Schmidt was taking the council "down memory lane" with his recitation of the background of the master plan and zoning ordinance. He also took issue with the lawyer’s suggestion that the council solicit outside help. "FOR 33 MINUTES this gentleman (Schmidt) really made a mockery out of the council that yoa need outside help," he said. A summer resident spoke of a Wawa store near his
home in Philadelphia. "If you saw what they do in our commuhity. you would not have one here," he stated.
