Police Captain Hearing Resumes

COURT HOUSE - Vineland Municipal Court Judge Samuel J. Serata is expected to decide today, * Nov. 3, whether any of the 18 departmental charges filed against Middle Township police Capt. Raymond Saundefs in connection with his presence at a Wildwood speakeasy when it. was raided'last August

should be dropped.

The hearing, which began last Thursday, wil‘

■sday, will at 1 p.rrl

Among those expected to testify is William Matthews, chief of detectives for the Cape May County Prosecutor’s Office. SAUNDERS, suspended from the force as a result of charges stemming from his presence at Swifty’s Seafood, contends he was there Aug. 14 when it was raided by state law officials just to buy a fish sandwich. Samuel Swift, owner of the restaurant recently pleaded guilty to operating the speakeasy and will be sentenced next

Monday, Nov. 8.

AT LAST week’s session, Saunders’ attorney Kenneth Mackler argued that 13 of the charges.should be combined or dropped because many- contain

duplicate facts.

JUDGE SERATA, who was named by‘ Superior Court Judge FVHip Gruccio to preside at Mk hearing, acknowledged mat he will make a decision on combining or dropping charges after he hears "additional testimony. The Township is

expected to call its last two

witnesses today.

At last week’s 3Mi hour hearing, testimony was heard from two ABC investigators, County Detective Captain Robert Elwell, and Middle Township Police Chief Edward Hansen. • « While considerable evidence was presented supporting the fact that Swifty’s apparently was selling alcoholic beverages wjthout a license, no evidence to date has been presented that clearly points to Saunders having any knowledge that the alcohol was being sold on

the premesis.

UPON REPEATED questioning by Mackler, Chief Hansen acknowledged that many, of the charges lodged against the - department’s second ranking officer presumes he

knew alcohol was being

Sold at Swifty’s.

Asked by the attorney If he "knew for a fact" that Saunders had no knowledge of alcohol being sold and did not enter the restaurant with the intention of purchasing alcohol, would that change his mind about the guilt or innocense of the captain — Hansen responded in the affirmative. He added upon further questioning, however, that his opinion of the quality work Saunders has performed over the years as a police officer has "to a certain extent" changed since the raid took place. While being charged with the numerous departmental violations, Saunders has had no criminal charges fil-

ed against him.

The hearing is expected to conclude Friday.
