State Tax On Estates ‘Foolish’

PRINCETON - Continuation of New Jersey’s transfer inheritance tax was described here as perpetuating a policy by tKe state of “being pennywise and pound foolish". New Jersey Banking Commissioner Michael M. Horn told the opening session of the annual Trust Conference of the New Jersey Bankers Assoc, that the nation, is causing a movement of affluent peo-

ple from New Jersey. "THEY ARE MOVING." he said, "not only to Florida, where the tax is far lower, but also to other sun belt states with similar lower inheritance taxes." Horn said that causes the state to lose a variety of -financial benefits which flow from the affluent population. Among those losses, he' sam, are lost sales and income taxes as well as "numerous other

segments of our economy that also lose". HORN SAID that "while there are other reasons other than the inheritance tax for some affluent individuals to leave? New Jersey, the inheritance tax very often tips Lhe scale towards a decision".

A similar criticism of the tAx was voiced by Newark attorney Marie L. Garibaldi, president of the New Jersey Bar Association, who addressed tbe closing session of the conference. Garibaldi said that an editorial in the April 8 edition of the New

Jersey Law Journal pointed out that there is an exodus of retired and elde*rly New Jersey resideifts to Florida. "WHILE THIS may be the natural consequence of the Florida sunshine," she said, "many people believe that pur excessive transfer inheritance tax drives many residents south." Garibaldi said that in the disposition of large estates, the New Jersey tax is par

ticularly costly. On a $50-million estate, she said, the New Jersey tax would be Approximately $7 85 million. That would be coupled with a federal estate tax of approximate ly $2 71-million for a combined federal and state tax liability of $10.56-miljion. If the same situation were to occur in Florida, she said, "there would he absolutely no state or federal death tax at all"
