AVALON - Superior Court .Judge Edward S. Miller has ruled that borough officials acted properly when they dismissed 18 of 21 Public Works Department employes after a Jan. 14 snow storm last year. Miller found that the employees did. in fact, refuse emergency snow removal work and that the refusal constituted an illegal strike. Three of the 21 employes, collectively known as the Avalon 21, were ruled insubordinate. and suspend-

ed for six months, retroactive to July. "A refusal of public employees to work is not a strike.” Miller maintained, "it’s a revolution.” “Here is a barrier island, in the dead of winter, sparsely populated, dependent on the public road for access even to a hospital. Failure to keep these roads open constituted a clear and immediate danger to the community and it is indeed fortunate that no disaster struck Avalon that night,” Miller added, "since loss of life might well have occured.”
