Commercial Draggers Operating Illegally?
It seems that as soon as a fishery bounces back there are confrontations between the recreational anglers and the commercial fishermen The problem comes when the twc^groups try to' fish the same dr^a, and the heat intensifies when the commercial boats are in areas which are actually off limits Weakfish are the latest problem, since they are here in great numbers. Part of the problem comes in defining to the recreational angler what is legal and what is not regarding commercial fishing While there are limits which keep commercial draggers out of Jhe bay and offshore, gill nfctters and menhaden boats are permitted to come into the beach and in the bay. Commercial clam boats are also permitted to dam close to shore in some areas. The licensing laws and the legalities of commercial fishing are complex and oftentimes, the commercial boats are doing what they are legally permitted to do. Unfortunately, however, there are times when they do not obey the law. Some recreational fishermen do know the differences in the various types of fishing rigs used commercially and others do not. MOST RECENTLY we have been getting calls concerning allegations of il-.. legal netting along the Jersey Cape Coast. ned down but we had calls from people who said they were sure that the boats were in reality dragging; that they were inside the three mile limit; that they were fishing for and catching weakfish and that they came in to the fleet of private boats in a reckless and arrogant manner and rah the private boats out of the area they wanted to
work.
Needless to say, it is frustrating at best to have spent a day in preparation for an outing on the water, packed a lunch and gassed up the boat, arrive on the fishing scene and either find commercial boats working there or be run out of the area because they want to work where you are fishing. If the commercial boats are operating legally and if they do respect the private boats which were there first, we can’t argue with their right to fish. Law actually dictates that fish and game belong to whomever puts the fish or animal under control. Prior to that time the fish and game belong to everyone and neither the commercial nor the recreational angler has any proprietory right to
them.
IN ESSENCE, the fish are neither "ours’’ nor "theirs" until they are caught. Many rod and reel anglers get frustrated when they see large numbers of fish being netted while they are only trying to catch a few for their own use. • And, in particular, it has to be a source of real annoyance when the small boat operator because of finances, beat size limitations or age and infirmities cannot go offshore for his

MEANWHILE, fishing on the Jersey Cape coast continues as if there was no end. Boats are finding plenty of bluefish, weakfish and fluke all aloru* the coast. Some days fhe fish are close to the beach and other days they are offshore a little farther. Sea Bass, porgies and blackfish are populating the wrecks and providing good action for the bottom fishing fraternity. Occasional big blues and weakfish are being caught on wreck trips. Surf fishing has also picked up, with blues ranging from snapper size to stammers being caught on cut bait, metal jigs and surface poppers Some kingfish are being caught along the North Wildwood bulkheads at Anglesea and back in the sounds. Weakfish are also , hitting mullet and squid baits as well as occasionally on Hopkins lures and.-plugs. Jerome Einbury of Sea Isle City, landed a 4^ lb. weakfish from the Sea Isle City surf on cut mullet bait. Waynt Wagner of Aston, Pa. caught a 13^4 lb. bluefish from the Avalon Fishing Pier. Elwood Miller of Landisville, Pa., caught a 9 lb. 5 oz. weakfish from thej>urf at Stone Harbor on spot bait. J. McGettigan of Philadelphia caught a 12 lb. 14 oz. bluefish on a buck-tail and mullet bait in the surf at North Wildwood. Frank Martorella of Norristown, Pa., caught a two-pound triggerfish on a piece of cut mackere and spinning gear

We spoke to Capt. Hudson Amory of the New Jersey Division of Fish, Game and Wildlife. He said his four-man enforcement staff did make an effort to enforce the laws but they were limited in manpower and equipment.
