Tax Fraud Penalties Mount Up
NEWARK — New Jersey residents had more than 63 million in civil fraud penalty recommendations and federal court fines assessed against them for income tax evasion in fiscal year 1983, according to the Newark District Office of the IRS. Civil fraud penalties totalled $2,684,974 during the 12-month period ending Sept., 30. This represented a 23 percent increase from the previous period, and was in part due to a new
law which imposes a civil penalty equal to 50 percent of the interest payable on the fraudulent underpayment. This is in addition to a penalty which comes to 50 percent of the actual underpayment. This is in addition to a penalty which comes to 50 percent of the actual underpayment. Tax fraud, which can include the willful filing of false returns or failing to file required tax forms, can also subject a taxpayer to criminal prosecution. Dur-
ing the 1983 fiscal year, 57 persons were convicted of criminal wrongdoing in New Jersey. In addition to receiving prison sentences totalling over 60 years and fines of $339,750, they were also subject to the civil fraud penalties. IRS explained that, although the normal statute of limitations for assessing additional taxes is three years, there is no statute of limitations for the fraudulent underpayment of taxes.
