Condo District OK’d

VILLAS - “Unless the ordinance is approved tonight, we bate no settlement and the case goes to trial,” Lower Township Solicitor Bruce Gorman warned the township committee Monday. The committee adopted the ordinance (No. 83-39), which amends Lower's zoning code by creating a condominium district -in a revised R-5 zone along the bayfront. That change will allow developer Carl Mitnick to build 480 condos in mid-rise buildings on his 30-acre tract near the Cape MayLewes Ferry landing. But — more important to the township committee — it will settle a law suit filed by Mitnick and developer Darryl K. Johnston and prevent the possible con-

struction of 1,554 houses if they won. IF THE TOWNSHIP won the suit, Gorman said, 677 units could be built; the settlement allows a total of 779 units on three tracts, one Johnston’s and two of them Mitnick's. Approval of the zoning ordinance settles the suit, Gorman added, but does not imply approval or allow construction on the tracts.' TTie developers must still run the gauntlet of required permits before breaking groudd. According to the terms of the settlement, though, the township has zoned Mit- - nick's bayside tract for condos and his 123-aCfe property along the Cape May Canal for 234 singlefamily homes on half acre and acre lots. Johnston will

be zoned for 65 singlefamily homes on half-acre lots within a 32.5 acre tract east of Bayshore Road and south of Fishing Creek. Only Mitnick has submitted plans, however, and those axe for “Canal Park,” the large tract behind Cold Spring Apartments. Those plans, Gorman stressed, are subject to local, county and state approval Originally, he said, Johnston submitted a proposal for 189 houses on small lots at his Bayshore Road tract; Mitnick wanted 765 on the canal and 600 more along the bay. The township “tried to zone the property out from under them” and both developers filed suit that later merged, Gorman said
