1 Anti-asbestos Funds in Bill

A. U.S. Senate bill, signed by President Reagan last month, garnered most publicity for its provisions calling for "equal access" to school facilities by student religious groups Yet, the Education for Economic Security Act (S. 1285) also authorizes funds for local district asbestos hazard abatement, teacher training in math and science, excellence in education programs and magnet school desegregation programs. S. 1285 CREATES a pro gram, administered by the Environmental Protection Agency, to assist states and local school districts in identifying and correcting asbestos hazards. It authorizes Congress td appropriate $50 million each year during fiscal 1984 and 1985 and $100 million for each fiscal year from 1986 through 1990. Local districts can receive loans or combinations of loans and grants for up to 100 percent of the cost of abatement plans. However, the grants, which will be based on local district financial need, can- ■ nbt exceed 50 percent of project costs. ACCORDING TO the bill, the EPA will distribute applications to all local school districts by mid-October. Districts must return the forms to the governor. Each application must contain a statement of need — to be certified by the governor — based on the following criteria: estimated district-wide per capita income and local tax rate compared to state average; ratio of project cost to district budget ; and the school board's borrowing capacity. The following month, the governor will provide the EPA with a state plan

describing procedures for maintaining records on asbestos presence in schools as well as abatement and detection activities. BY FEBRUARY 1985. the governor will submit to the U.S. Secretary of Education a priority listing of schools based upon the magnitude of asbestos hazards as well as local district applications for financial assistance. Within a 120-day period

after receiving the state's priority listing and applica tions, the education secretary will review the material and the federal EPA administrator will determine the awarding of financial assistance on a school-by -school basis The EPA will also have the authority to establish regulations for implemen ting and evaluating abate ment projects, including the qualifications of contractors.
