Management Plan. I The transfer of development rights is a relatively I simple concept, but it is 5 often misunderstood by the | public simply because it's inew and different. SINCE development op- | portunities are very

limited in the Preservation Area and in Agricultural Production Areas, owners of land here are assigned credits which can be sold to developers who wish to build homes in Pinelands Regional Growth Areas. These growth areas are located where most future development will occur in the Pinelands. The properties which are assigned credits are called "sending properties" and those where credits are used after a ''sale are called • receiving properties." Owners of "sending properties" are assigned credits based upon a formula which takes into consideration the size of the property and whether it contains uplands or wetlands. If the land is used for farming the number of credits is automatically , doubled. DEVELOPERS who buy credits may redeem them in a Regional Growth Area By doing so. they are entitled to build a set amount of houses over and above the

i number that would normalI ly be allowed by a local zoning ordinance. Each zoning ordinance in a Regional Growth Area municipality now contains a provision on the amount of additional houses (called a "bonus density") that can be built using the credits. When an owner of credits sells them the "sending property' ' *is deed restricted. A conservation easement is placed on the property which permanently excludes the construction of new houses there. CREDITS CAN be sold in two ways. A private sale can occur between a propert.y owner and a developer at a negotiated price. A public sale can also be accomplished in Burlington County. u Here, the county has established a Conservation Easement and Pinelands Development Credit Exchange Board. The coun'y will pay a fixed price of $10,000 per credit. It then auctions the credits to in-

SALES OF Burlingtor I County credits have resulted in additional "bonus units" for projects in Medford and Waterford. Sales will soon be finalized for developments in Galloway. Medford and Monroe Townships. To date, the Burlington County exchange has purchased 46 Pinelands Development Credits, mostly from agricultural -land which will now stay that way. The county is considering setting up a similar program within a predominantly agricultural community just outside of the Pinelands. ON THE horizon is even better news for the PDC program. Legislation sponsored by Senator Raymond Lesniak and Assemblywoman Barbara Kalik will create a state Pinelands Development fredit Bank to buy and sell DCs. ed d d

It will also allow the state to guarantee loans when PDCs are used as collateral. This will be especially helpful to farmers because it is the t first state-guaranteed agricultural loan program in New Jersey. Additionally, the bill will help finance credit banks in any Pinelands county which desires to esUiMsh an exchange similar to Burlington County's. THE PINELANDS Commission has produced a brochure for property owners in the Preservation Area and Agricultural Production Areas. It explains the PDC program in detail, how credits are allocated, and what . steps a landowner should take to determine how many are assigned to a property.
