; Bridge Opening Can Cause Trouble
CAPE MAY - "Is this opening necessary?" That's a question boat operators should ask themselves before signaling one of Cape May County's busy drawbridges to go up. If the answer is no. it could cost the operator a $1,000 penalty, warns the U.S. Coast Guard. The Coast Guard, in an effort to reduce unnecessary bridge openings, wants to remind boaters of the proper procedures and their responsibilites when requesting a drawbirdge to open. THE COAST Guard has law enforcement jurisdiction over "navigable waters" of the United
States. Basically, these are waters that boats can safely navigate on. They are a national resource that has been in existence since the beginning of the nation. The law recognizes that the waterway was in existence before any bridge . crossing it. Therefore boaters are given the right-of-way over bridge traffic in most instances. AMONG Coast Guard functions, it insures that drawbridges are operated in such a manner that they are a minimum obstruction to the waterway. The service also insures that persons using the waterway do so in a lawful mai-ner. A boater requesting a drawbridge to open, must signal the drawtender ( the signal me arawienaer ( ine
person who opens the drawbridge). The drawtender is to acknowledge the signal and open the drawbridge. There are several ways to signal a bridge to open. A sound signal may be given by whistle, horn, megaphone, hailer, or other device capable of producing a signal loud enough to be heard by the drawtender. THE REQUIRED sound signal is one prolonged blast of four to six seconds, followed by one short blast of one second. If the drawbridge cannot be opened immediately, or is open and must be closed promptly, the sound signal of five short blasts must be sounded by the drawtender. Another method, a visual signal, may be given by raising and lowering a white flag vertically or raising and lowering a white, amber or green light vertically. The drawbirdge acknowledges in the same manner. IN ADDITION, the signal may be acknowledged by showing a fixed or flashing white, amber, or green light or lights If the drawbridge cannot be opened promptly, or is open and must be closed immediately, the signal of a red flag or light swung back and forth horizontally or a fixed or flashing red light or lights must be made to acknowledge the request Probably the best method a boater can use to ' signal a drawtender is by radiotelephone communications tVHF-FM Marine Radio) IT IS THE best way to . avoid any confusion in the request and drawtender s acknowledgment Mariners should consult their copy of the local Coast Pilot, where specific radio frequencies are listed Some bridges require specific signaling methods and these are found in the Coast Pilot The Federal Register ind the Coast Pilot publish special conditions for the openings and closings of certain bridges Due to in frequent use of a draw In vessels the Coast Guard (•ranted 15. may grant special permission to close a drawbridge and leave it unattended for a specific time. UNTIL RECENTLY, thcCoast Guard was powerless to take action in cases where vessels have been delayed because ofdrawbridge failing to open in a timely manner. A recent act gives the Coast Guard enforcement power. It states that no owner or operator of a bridge, drawbridge, or causeway shall endanger, unreasonably obstruct, or make hazardous the free navigation of any navigable waters because of failure to kep it in proper working order. WHILE THE burden of the law appears to fall upon the drawbridge owners, the public use of the waterways is also regulated. No boater shall signal a drawbridge to open for any nonstructural apparatus which is not essential to navigaiton or which is easily lowered. Structures essential to navigation may include those which support radar antennas or running lights, but if the post to support
these can be lowered, it must be lowered to pass under the drawbridge. IT SHOULD be clear that the apparatus such as a radio antennae. Bimini top, false stack, decorative mast, or fishing outriggers must be lowered rather than signaling the bridge to open unncessarily. Bridge owners and operators have notified the Coast Guard if they are being caused to open their drawbridge when they believe that the boat could have cleared without the bridge being opened or cleared if the apparatus had been lowered prior to reaching the drawbridge. BY REGULATION they must open when signaled. But, if they have to do so needlessly, they complain with justification, for each oepning causes wear and tear on the bridge mechanism. Moreover, each opening during the summer causes long lines of irate motorists who vent their displeasure on the drawtender. Violators are subject to a $1,000 civil penalty for each unnecessary opening they cause. •
