Waitresses' Tip Pooling Opposed

In a letter to IRS Commissioner Roscoe Egger, Hughes said tip pooling would totally destroy the incentive for waiters and i waitresses to provide i superior service. At the i same time, he said, it would undermine their i ability to raise their stan- i dard of living through hard work. i HE URGED Commissioner Egger to withdraw i the petition, which the IRS < filed earlier this year with the New Jersey Casino i Control Commission. "I recognize that, over the years, the IRS has faced some difficult problems in obtaining full reporting of tip income," Hughes wrote. "At the same time, i however, I am shocked and < astounded that the Internal Revenue Service would propose a plan that would confiscate and redistribute workers' earnings simply ; to facilitate the collection < of revenues. "There can be little question that if this proposal were allowed to take effect, numerous cocktail waitresses would be denied the fruits of their labors for no purpose other than the convenience of the IRS. By the same token, the poor waitress will receive poor tips. "The proposal submitted by the Internal Revenue Service, to require pooling of all tips, would totally destroy any incentive a waitress might have to provide superior service. It would become impossible for the most outstanding waitress to earn any more than the very poorest. I frankly think the IRS has no business interferring with people's livelihoods and denying them the ability to raise their standard of living through hard work." However, he said this is carried out under the strictly controlled and highly supervised environment surrounding the gambling tables, and is required to protect the integrity of the process and avoid the appearance of collusion with the players. "No similar need or conditions exists in other areas of the casino," he wrote. "Accordingly, I strongly urge you to withdraw this petition immediately." In a related matter, Hughes said he is continuing to check into allegations by casino workers that the IRS overestimated the amount of income they earned from tips. He has asked the IRS to provide full documentation of the methodology used to arrive at the workers' tax assessments, so that a deteimination can be made if the casino employees are being treated in a manner which is fair and equitable.
