Judge Continues Repici Appeal
COURT HOUSE - Fourth-hand, hearsay evidence that Realtor Thomas J. Repici had sewage connection permission from former Middle Township Sewage Commissioner Michael Vistenzo surfaced as the basis of Repici's conviction appeal heard last week. Repici attorney Joseph Fusco of Atlantic County called former Vistenzo secretary (and present township zoning officer) Carol Nicoletta. former township grants coordinator Barbara Beitel. Assistant Prosecutor Robert Wells, and Repici attorney Joseph Gindhart, also of Atlantic City. The scenario was that Nicoletta's son. Michael, who worked for engineer A1 Herman when he oversaw
laying of a sewage line Ho Romney East, allegedlytold his mother he'd heard Repici had permission to connect his Hy-Land Motor Inn to the subdivision sewage line. Ms Nicoletta allegedly told Beitel who allegedlytold Wells who allegedly told Gindhart. Nicoletta last week reportedly agreed she'd talked to Beitel about the case, but denied her interpretation of what Nicoletta's son said. Also in dispute was whether Wells made the comment before or after the trial. After hearing all this, Superior Court Assignment Judge Philip A. Gruccio continued the case tentatively to Aug. 22 so that
Michael Nicoletta can be interviewed. Also testifying Aug. 1 were Repici and his wife, Joan. - Repici, sentenced May 30 to a $1,000 fine, one-year's probation and at least 180 hours of community service for "theft of services" for connecting to the line without permission, filed for a new trial in June on grounds Wells withheld information that Repici had permission. Repici did not make that defense in his trial, and Vistenzo has denied it.
Since Wells was testify- • ing as a witness, the county prosecutor assigned Dean Sykes to represent the state. The New Jersey Real Estate Commission, due to hold a disciplinary hearing on Repici's conduct July 30, postponed again, awaiting final determination of his case. Since it doesn't meet in August, it will be early September before that can come up. The commission has said a revocation of Repici's Realtor license is likely if he is finally convicted. He is the broker at Avalon Real Estate's Cape May Court House office. The services he was convicted of stealing were valued at $179: the $100 application fee and the annual $79 sewer fee for a home. Repici's home was in the motel at the time.
