Foreign-Built Boat Buy Questioned
Individuals counting on saving money by purchasing a foreign-built boat are forewarned by the Coast Guard that as importers, they may be responsible for compliance with applicable Guard safety standards and regulations. Many Americans are buying boats direct from the foreign manufacturer to take advantage of the buying power of the dollar as compared to weaker foreign currencies. RECREATIONAL boats manufactured in the United States and those imported to the U.S. must comply with applicable Coast Guard safety standards. The U.S. importer of a boat built in a foreign country is considered the "manufacturer" for the purposes of compliance I with the regulations because the Coast Guard I has no legal authority over foreign manufacturers The U.S. importer must certify that an imported boat complies with safety standards and regulations. He is also required to conduct defect notification if a boat is found to contain a defect which creates a substantia] risk of personal injury to the public. THE REQUIREMENT for defect notification extends for a period of five years after the boat is manufactured or imported. Thus, an individual who imports a boat might have to make substantial alterations to bring the craft into compliance with Coast Guard standards. Also, an individual who sells a foreign-built boat could be held liable for repairs to the boat for substantial risk defects for
a period of five years after the boat was imported. Finally, an individual who buys a boat from a foreign national who has brought it to the United States for the purposes of sale may be assuming sole responsibility for the war-
ranty on that boat. Where recourse is normally available from U.S. manufacturers and importers, no such support may be expected from the foreign manufacturer of a boat or the foreign national who sells it.
