Upper Limits Growth, Increases Lot Sizes
By GREGG LAWSON TUCKAHOE - The Upper Township Planning Board last week approved a new master plan that limits development in the wetlands and Strathmere and increases the minimum- lot size required to build in residential areas. The new plan, which updates one done in 1975, will not become effective until the zoning ordinance is changed in the next month or two. More than 55 residents attended the meeting to view the new plan, prepared by Banisch Associates of Sergeantsville. In his opening remarks, township planner Frank Banisch said some areas of the wetlands are developable, but also have the most potential for groundwater contamination. HIS PLAN WOULD have eliminated all development in that area, a proposal that drew fire from residents who will be in the new Conservation (C) zone. "You're robbing me of the value of my property, robbing my children of a chance to build a house there," said Joseph Wright of Tuckahoe. "You're telling me I can't build on land I own." echoed Carol Lee Corson of Tyler Road. "I agree it is a sensitive area," but with fiveacre lots or 10-acre lots, something can be done." "Nothing about what we're doing will prevent you from going to the zoning
board and asking for an exception (to the plan)," Banisch said. "You have to understand that most of what we're talking about is to prevent developers from building multi-unit developments there " "There will still be the likelihood that someone can build on their lot," he continued. "But there will be little likelihood that large developers can come in and build 100-unit dwellings." THE BOARD UNANIMOUSLY passed a resolution by Mayor Daniel Beyel to allow current lot owners to build one dwelling on fiveacre parcels of land, the existing minimum. However, the board stipulated that if the landowners subdivided or sold their properties, the new minimum would be one dwelling for each 10-acre parcel Banisch's original concept for the shore protection (SP) zone in Strathmere would allow residents to rebuild their homes only if storm damage was less than 50 percent of the value of the house. "If I lose my house, what happens to the value of my ground that the township says is worth $48,000," asked Ted Banford of Whale Beach. "Do I just lose it?" "THE STATE WILL buyit at bargain-basement prices after the storm." Banisch said. Banisch said the state figured it would be less expensive to purchase the properties than continue to
replace dunes in that area "You've got to think not just about the bulk of my people, but the people who say "What's going to happen to my house?" " said Henry Leiner of Strathmere. The board decided to allow property owners to rebuild their houses regardless of the amount of damage, but no new development will be allowed in the (SP) zone. The board agreed all existing structures will have to be catalogued. A 15-BLOCK strip inside the shore protection zone has been zoned Resort Residential (RR). The minimum lot size in that district was doubled, from 4,000-square-feet to 8.000-square-feet. The other major change in the new plan, the Moderate Density Residential iR> district replaces the former R-l and R-2 zones. Minimum lot size in R-l was 30.000-square-feet and 20.000-square-feet in R-2. The new minimum in the (R) zone is 40,000-square-feet, more than the 35,000-square-feet minimum the county recommended to meet water quality protection goals.
