Chamber Letter Attacks Sewage Commission
By GREGG LAWSON COURT HOUSE - The Middle Township Chamber of Commerce has attacked Middle Township Sewage Commission in a letter signed by its president, Frank Ross, but prepared, Ro6s siad, by a frequent commission critic, attorney Frederick W. Schmidt Jr. Ross said Monday the chamber's board of directors authorized him and two other members to approve and send the letter to township committee, but said he could not remember who the other members were because "each read it separately." Chamber sources said the two were Court House builder Robert Hodges and Charles Raff, owner of Raffs Moving and Storage here. SCHMIDT'S LETTER praised the Court House Convalescent Center, which had to install its own septic system because the district's sewage treatment plant is at capacity. Schmidt is one of five principals of Magnolia Associates, which purchased 7.8 acres on Magnolia Drive and later sola 2.5 acres to the nursing home. Magnolia's other partners included Thomas J. Repici, John Vinci, William H. Tozour Jr. and David J. Kerr. They later bought out Vinci and, under the trade name Holly Associate*,
sold the land to the nursing home. Holly Associates' plans to build a shopping center and restaurant adjacent to the nursing home have been stymied by the inadequacy of the sewage treatment plant. SCHMIDT'S LETTER comes just weeks before 4he sewage commission must convince township committee it should be permitted to prepare plans for the district's future sewage needs and connection to tne county Municipal Utilities Authority (MUA) regional sewage treatment plant. Those decisions — where and when to extend sewage service — may determine which ' developers will share in the township's anticipated growth. Schmidt's letter included these charges and complaints: •THE COMMISSION doesn't have an office and regular office hours. •Its records, especially to and from the state Department of Environmental Protection, aren't open for public inspection. •The vacancy created by Commissioner Mike Mill's resignation in December V *
hasn't been filled by appointment or election as required by law. •The commission provides sewerage treatment to users outside of district boundaries, but is unable to provide it for many property owners within the district. •It hasn't entered into a service contract with the MUA in order to ensure that the district can comply with new Environmental Protection Agency standards effective July 1, 1988 •A DEP-required water conservation program wasn't implemented by the commission by ^\pril 1. 1985 and hasn't begun yet. •The commission hasn't implemented a plan to eliminate infiltration and inflow (rain water that enters the collection system and burdens the treatment plant) as required bv a DEP court order and letter. •It permits more flow to the treatment plant than it was designed to treat and hasn't taken corrective action. •It permits the discharge of improperly treated effluent into Crooked Creek. •"Riere is no consistency in the commission's treatment of applicants. Copies of the letter also were sent to the township Board of Health; the county Environmental Commission, Health Department and Planning Board; the DEP and the Court House Neighborhood Association.
