Density Curb Off In Stone Harbor
By SKIP GLADUE STONE HARBOR - A standing-room-only audience. sprinkled heavily with lawyers, heard the Stone Harbor Borough Council withdraw a controversial residential density ordinance and its amendments at its June 3rd meeting just moments before the public hearing on the issue. (See letter to the editor.) The reason for the withdrawal, as explained by Mayor Arden Hand, is that the ordinance was discrimnatory and would have no chance of standing up in court. THE MOTION to k withdraw passed 3-1 with Councilman William Cathcart dissenting Absent were Councilmen ■ Louis C. Clelland and ft Robert Boyer. f The issue, which has bounced back and forth . between the planning I board and the council, had ■ the support of council ■ president Eric J . ■ Arenberg. He said that he I has been a supporter of density control all along, and absolutely no pressure was brought upon him to change his mind. "The "solicitor advised that there would be a (> snowball's chance in hell of defending it in court," said Arenberg as he agreed to the withdrawal. THERE WERE some obviously irate members of the audience who came in some instances as far as 140 miles for the hearing. This density ordinance has never had the full support of the council, passing on first reading by only one vote (3-2). Councilmen Kenneth Hawk and Robert E. Sellers Jr. have opposed the ordinance consistently. Following the meeting Hawk said he is a firm believer in density control but would rather see it approached by another way. Planning Board Chairman John Kincaid said the decision would no doubt be discussed at the work session June 9, and perhaps approach density from a different angle. IN OTHER action the
council approved unanimously on second and final reading an ordinance restricting residences in the business district, and an ordinance controlling the appearance of shop windows during the offpeak seasons. Alan Lovegrove, Avalon, was appointed construction official effective June 10 to replace Herbert Hornsby Sr., who will retire July 31. A builder and contractor originally from Wales, he and his wife have been residents of Avalon for 20 years. He served as Avalon's building inspector 1978-80 and worked with the borough engineer in the rehabilitation of water and sewer lines there. CURRENTLY he is supervisor at the treatment plant. He holds a building inspector's license, a building sub-code license and a provisional construction officials' license. Liquor license renewals were approved for , Henny's.Rab | Pub(Snickers) and the Stone Harbor Yacht Club. Although the police chief recommended docking the police boat at different docks on diffrent days, the council moved to accept the offer of a slip at the Stone Harbor Yacht Club at no charge.
