r-Jersey Cape Historically 9K I By John Merrill |
Based on research into the history of the county, this article will pertain to what is probably the first recorded murder, (though it was decided in court to be a case of manslaughter) to take part within the county. It involved a Lenni Lenape Indian male killed in 1736 on Foxborough Hill in Beesley's Point over an argument arising from too much alcohol and the refusal to leave when asked. After a quarrel between Joseph Golden and an Indian brave, the Indian was "unintentionally killed" by Golden.
BECAUSE OF the death of the Indian, Golden had to leave the area in fear of the possibility of retaliation by members of the Indian's family or of his band. According to the inquest that followed the death. Golden claimed to have hired the Indian and an Indian couple to scratch flax (the breaking down of flax fibers in order to use them for making linen, or mixed with wool, linsey-woolsy). In payment for these services, they would earn one quart of ram each for their labor. With payment made by Golden, the hired Lenni Lena pes proceeded to get intoxicated. ACCORDING TO Golden, he and the Indian began to quarrel over the subject of their intoxication when Golden, having had enough of the argument, told them to get out of his house; they refused. The Indians, not understanding the reasons for his request, would not leave, where upon Golden grabbed a cradgel and attempted to foreceably evict them. Both Indian men then jumped upon Golden and forced him to the floor, with one of the Indians putting him into a headlock, and used so much force that Golden feared for his life. JOSEPH STITES, a friend of Golden who was present during this confrontation, succeeded in seperating them. Golden, once more standing, grabbed a larger stick and told them again to leave. Once again, the more boisterous Indian male rushed Golden and Golden, in self defense, proceeded to give the Indian a solid blow with the stick to the top of the head. The Indian fell and died on the spot without as much as uttering another word. DURING THE trial, which was held in Gloucester, Golden and Stites admitted that they had not had any disagreements with the Indians prior to giving them the ram. The jury, considering all the evidence presented, found Joseph Golden not guilty of murder, but guilty of manslaughter. Later, in the history of the county, it would be conDate Shift COURT HOUSE - The July meeting of the Cape May County Council on Alcoholism will be held on Thursday, July 10, (instead of the usual second Tuesday of the month) at 7:30 p.m. in the Department of Health Building, Crest Haven Complex.
