UNFAIR SUItSriTUT/ON. There liaa been considerable interest attached to controversies in recent years between manufacturers of trade marked and advertised goods and dealers for price maintenance and against sulistitution. In nearly every case the courts have decided that a manufacturer lias the right to set a price on his goods and demand that dealers sell at these prices and no other. This prevents one dealer ■felling a nationally advertised article at less than cost to stimulate trade and create an impression with the buying public that all the other standard articles he has for sale are equally low priced. An interesting case somewhat different, and sure to set a new standard is the one of the Standard Oil Co. against certain dealers in Atlantic City. Three dealers in fuel oil in Atlantic City were served this week with preliminary injunctions issued on the application of tire Standard Oil Comp my of New Jersey, by Chancellor Stevens, restraining them from using “ Standard Gas" and “ Standard Gasoline ” as the names of a product they offered for sale. The interesting queslu-n of the difference between a noun and an adjective in the priurotion of trade is brought up. The papers in the case allege that the term “ Standard Gas ” has been used widaly through the State to describe the gasoline manufactured by the Standard Oil Company. Many garages which sell the Standard Oil Company's product were shown to have erected signs of their own which read “Standard Gas," despite tl»e fact that the Company famishes signs describing its product as ** Standard Gasoline ” and “ Standard Motdr Gasoline ” was described to sustain the plaintiff's claim to tb^use of the nouns which have liecotne familiar all over the State featuring Polarine and Standard Gasoline." The Company contended that the names “ Standard Gas ” and “ Standard Gasoline" have now become peculiar trade names of its product, and that persons who ask for gasoline under these names in practically every instance arc seeking to buy its product and nothing else, and it claims the right to use the word “ Standard ” in the manner it is used, asan i<ieutifyinj»tenn. Competition in the gasoline business in New Jersey is very active, and various dealers who do not sell the Standard Oil Company's product have sought to increase their business by displaying signs reading “ Standard Gas," and at thesame time have furnished the public, not with the Standatd Oil Company’s gasolii with something else which, whatever its merits, is not " StauUaid

Gasoline."

The papers in these cases show also that one at least of these defendants, on being remonstrated with by the Standard Oil Company for his use of this name, vigorously asserted that in doing sc he was within the law. This is the very question that the Standard Oil Company wants to test and have settled by a legal adjudication. The settlement of this controversy will be watched with interest for it seems mauilcstly unfair for a concern to spend thousands of dollars creating a demand for its goods, only to have dealers take advantage of that demand by palming oil an inferior artichunder the advertised trade name oj one similar. On the face of it, it seems as though the Standard Uil Company will surely win this

1NI.F.T BRIDGE SEEMS SURE All of Cape May County can well icjoict- at the action taken by the Board of Freeholders on Satuiday in making the first definite step to the construction of a bridge actuss Corson's Inlet, from Ocean City to Upper Township and Sta Isle City. There seems to l»c nothing in the way of this bridge being built, unless it be some serious objection fiom the lower end ol tin county. That such opposition will develop is lianlly likely, fot ever) one must understand that this bridge is only the fitst step, taken at the ouly logical place to make a stall, of a real (Icean ItouK van from Ocean City, through all the resorts, to Ca|K- Mav City. Tin will eventually come. That is as sure as the rising and sitting c the sun. All efforts of the Freeholders and all force being brought to bear on them, is to merely hasten it. The benefit to the entire county of this bridge cannot be csti-1 mated. The increased real estate values along its route, of which tin County receives a shaie, will more than pay for the bridge IkTuk the bonds matuic. And the State aid which we are assured of re j cciviog will lessen the butdett for the county. With the wisdom that ap]wars to govern all the Board's action.-. I it has been concluded not to attempt to build the luidgcou the cast,! or ocean, side of the existing railroad bridge, hut rather to cioss on ^ the west side, continuing fioin Bax Avenue in Ocean Citv. This has a two-fold advantage. Fust it eliminates three tailiuadcrossings, twn ! on 9th Street, Ocean City, and one at 50th Street The second am) i really gteatrt advantage, is Dial building the road to the west o!) the 1 ail load will give the new bridge the benefit of the protection i afforded by the tailtuad btulgc, w hich it is sate to sax will double the life of the new structure. The attempt to cress on the east side i would have lieeu courting disaster, as the sands are constantly ^ shifting and the breakers come close in skorewa d. All jn all, the projeef has.been well thought out. All that now j ^^ariv ^ to jwish it ! make it a reality. Ami there
