UNFAIR SUBSTITUTION. There has been considerable interest attached to controversies in recent years between manufacturers of trade tnarked and advertised goods and dealers for price maintenance and against substitution. In nearly every case the courts have decided that a manufacturer 1ms the right to set a price on his goods and demand that dealers sell at these prices and 110 other. This prevents one dealer selling a nationally advertised article at less than cost to stimulate trade and create an impression with the buying public that all the other standard articles he lias for sale are equally low priced. An interesting case somewhat different, and sure to set a new standard is the one of the Standard Oil Co. against certain dealers

in Atlantic City.

Three dealers in fuel oil in Atlantic City were served this week •with preliminary injunctions issued on the application of the Standard Oil Comp-ny of New Jersey, by Chancellor Stevens, restraining them from using “ Standard Gas ” and “ Standard Gasoline " as the names of a product they offered for sale. The interesting question of the difference between a noun and an adjective in the primotion of trade is brought up. The papers in the case allege that the term “ Slandaid Gas ” has been used widaly through the Stale to describe the gasoliue manufactured by the Standard Oil Company. Many garages which sell the Standard Oil Company’s product were shown to have erected signs of their own which read “ Standard Gas,” despite the fact that the Company furnishes signs describing its product as “ Standard Gasoline ” and “ Standard Motdr Gasoline" was described to sustain the plaintiff's claim to th^use of the nouns which have Itccomc familiar all over the Stale featuring Polarine and Standard Gasoline." The Company contended that the names “ Standard Gas " and “Standard Gasoline" have now liecoiuc peculiar trade mimes of its product, and tiiat persons who ask for gasoline under these names in practically every instance are seeking to buy its product and nothing else, and it claims the right to use the word “ Standard ” in the manner it is used, asan identifying term. Competition in the gasoline business in New Jciscy is very active, and varions dealers who do not sell the Standard Oil Company’s product have sought to increase their business by displaying signs reading “ Standard Gas," and at the same lime have furnisher) the public, not with the Standard Oil Company's gasoline, but with something else which, whatever its merits, is not “ StanUaid

Gasoline."

The papers in these cases show also that one at least of these defendants, on being remonstrated w ith by the Slaudatd Oil Company for his use of this name, vigorously asserted that in doing so he was within the law. This is the very question that the Standard Oil Company wants to test and haw settled by a legal adjudication. The settlement of this controversy will be watched with interest for it seems m.-milcstly unfair fot a concern to spend thousands of dollars creating a demand for its goods, only to have dealers take advantage of that demand hy palming ofl an inferior article under the advertised Uadc name 01 oik similar. On the face of it, it seems as though the Slaudatd Oil Company will surely win this

All of Cape May Comity can well rejoice at the action taken by the Board of Freeholders on Salmday in making the first definite step to the construction ol a bridge across Corson's Inlet, from Ocean

City to Upper Township and Sea Isle City.

There seems to be nothing in the way of this bridge being built, unless it be some serious objection fiom the lower end ot tin county. That suck opposition will develop is haidly likely, lot every one must understand that this bridge is only the first step, Liken at the only logical place to make a start, ol a ical Ocean lioulwaid from Ocean City, through all the results, to Cajie Mav City. This will eventually come. That is as sure us the rising ami setting ol the sun. All efforts of the Freeholders and all force being bionghi

The benefit to the entire county of this bridge cannot be esti-

mated. The increased real estate values along its route, of which tin County receives a share, will more than pay for the bridge belou
