He also stated the Highway Department advised him the road must not have a grade greater than seven degrees. On Wednesday morning Walter J. Fenderson. former Tax Collector of Cape M»y City, was lodged la the Trenton penitentiary starting a term of two to three years. Fenderson pleaded non-vult to twenty-one indictments charging him with embezzlement of the funds of Cape May City. The defalcaUons amounted to approximately $19,000. The bonding company which carried Kenderson's bond repaid the city $10,000. The plea of non-vult created a surprise, for It was understood that Fenderson was going to fight the charges. Judge Herbert Bartlett, of Cumberland County, presided at the request of Judge Eldredge. Wasted Sentence Delayed Former Jud;e James E. Hildreth, who represented Fenderson. requested the Court to delay sentence until January. In order that the balance of the money due the city could be repaid. Judge Bartlett denied the request, stating Fende; son bad had ample time to make restitution. Prosecutor Campbell restitution did not condone the

crime.
