Tbe opinion contains a rebuke seldom administered by the courts. Tbe proceedings were brought by Henry Black against tho Mivnr and. Common Council of Gloucester Oty to compel the Council to accept aud file an application for a Hqnor license. The hill in question was Introduced by Senator Miller, of Salem County, aud as first drawn wa* applicable to all third and fourth-class cities. It would have applied to Cape May City. Salem, Woodbury, Millville, Atlantic City, Beverly, Gloucester aud a score of other places. such a storm of opposition was. aroused that a proviso was Inserted ex-, emptlng from its provisions all such cities then had excise boards. Senator Evans, however, did not wont the courts hi say whether license* should be granted in Atlantic City, and he had an amend* meut reported by tbe Sfcnate committee exempting cltlcc of over 25,000 inhabitant*. Then Senator Stokes discovered that tbe act would apply to Millville, where there has not been a liquor license for twenty-fire year*.
