There is also s rumor that the Japanese assault on Port Arthur has been repulsed with heavy loss. The Japanese army has been ordered by the general staff at Tokyo to renew its attack on Port Artbur and to take the main fortifications at any cost. At one time the entire business section of Flushing was threatened. The fire started In a stable owned by I- Boyer A Bom, and owing to defects In the fire alarm system It was nearly half an hour before the village firemen were notified. When they reached the scene the flames had spread to adjoining buildings and were beyond control by the local dapartmant Apparatus and men were sent from Long Island City and other nearby points, and after sereral hours the spread of the fire was checked. The Boyer stable was entirely destroyed. and a otarred body, supposed to be that of Daniel Hogan, was afterward tound in the ruins. Here four horses were also burned. Fifty-five horses ware taken from the stables of Frederick C. Ayer, a liveryman, and four others were burned, with building. The case Involves a bequest of about $2^00.000, made to twenty differit colleges by the late Daniel G. Fayweathdr, a leather merchant of New York, who died In 1800. The will was attacked by Mr. Fayerwpother’s widow and two nieces, fraud bring charged. The case was pending In the court for many years and has been before the supreme court on several occasions. The last decision op it was rendered by the circuit court for the southern district of New York and waa favorable to the colleges. The heirs then appealed to the supreme court, but the opinion affirm* the finding of the circuit court. The opinion of the court was delivered by Justice Brewer and held that the had been previously adjudicated. The beneficiary colleges are Rowdoln. Dartmouth. Williams, Amherst. Wi leyan. Yale, Columbia, Union. Theological. Hamilton, Rochester. Cornell. Lafayette. Lincoln. Virginia. Hampton. Maryville, Marietta, Adalbert, Wabaah and Park.
