Recover Delay Penalty.
In the United States circuit court last eek, as mentioned in last week’s HxkaID a •90,000 da nage suit was filed by George C. Dietrich and Seward L. Bowser, lately trading aa Dietrich A Bowser, of Philadelphia, J. Harper Dripp*. Frank L. Luckenbach and William Y. Trlpple, trusters of George C Dietrich, rucceasor to the late Brm of Dietrich A Bowser, agaicst the city of Cape May for breach of contract. It la alleged by the claimant* that on May 85. 1903. contracts were awarded to Dietrich A Bowser by tbecityof Cape May for the construction of a beach Improvement front, for the furnishing of materials and the 1*\ ing of a sewage disposal system, the building of a pumping
and a storm water sewer.
