Thoae who kno« Mr. Kool have meaaumi tua high ideals' hts nobility of character, hi* aingli purpose, and bis unseltUh dev the party lor which tie has done so much resent the imputation that an ambition to he a canid ale for the presidency in 18US prompted acceptance oi ' the Sjecrelaryahip of State. No such temptation waa needed, and none waa placed befor him, ior that would have raised a most effective harrier lo the fuitUlmcbt of the President's dewire. No two men in the country understand each other better than President Kooseee.t and EUbu Kool. Their long-con-tinued intimacy has cemented a friendship of an uusual tpye. It waa the earnest appeal of one great hearted, warm-blooded friend to another equally great-hearted a*d noble-minded that made Elihu Koot the successor of John Hay, and brutgbt to this country, and to all the peoples ui the world, a sense of satisfaction as exhilarating as it is ,. extraordinary.
Cape May The Select Cape May never looked prettier than It does at prsenl, with its green velvetlike lawns, and its innumerable beds ol hydrangen. There seems to be something in the soil and climate which dedt veto pa the aixe and color of these flowers. From one end of Columbia Aveneu to the other, in 11 ages street,' South Lafayette street. Ocean s and Washington street almost every lawn U covered with multi-colored bydrangeas. Even on beach Avenue Where the ocean spray Hies on the lawns when the breexe is blowing briskly from the aonth, the hypraugeas
grow luxuriantly.
Around the Weighlinan villa, skirtIng the residence of Dr. Charlie N. Davis, Srudding the green of the charming Bogera' villa, ami in charmingly arranged about the fine residence of J. Wesley Allison, there are thousands of these plants with their nodding plumes, swaying gently in the breexes. Cape May at this season of the y. Is a ventable bower of color and green, with Sowers of almost every deecription, mingled with shrubbery, bosh and tree.

Tuner the constitution of 17TC Ni Jersey, like New York, made the highest judicial tribunal the Council, or benate, as now called, and this in New Jersey was |-resid'd over by the Governor aa ex-othdo president. Thu, of course, was patterned after the House of Lord* of England, in which body rested the last resort in all case* of law and equity. The difficulty that naturally arose was that mem ben of the Council were not always Dwyers- At times there very lew and sometimes none. The direction of the court in the right was left to the Governor, who had to be a Dwyer. because, under the constitution of New Jersey, be was ex officio Chancelor. 1 he dissatisfaction with a court this character, changing, as It oouid, yewriy by the annual election erv great and waa one of the principal causes that led to the cslliug -onsutulloual Convention in 1&4H, the main purpose being to incorporate in the fundamental Da the entire paration and independence of the three great departments of the government, namely, the executive, judicial
and legisDuve.
it came to form the Court ol Errors and Appeals the debates'in the Convention showed that it w^s the most diihcnlt and delicate task. 1 he Dymen iturelly resented the idea that the old Court, consisting of the Council, should be abolished, and fought hard lor some itattoo at leaat in the judiciary. In looking over the reports ol the constitutional Convention it will be seen that many strenuously objected lo the creation of a separate Court of Appeals imposedeutirely of lawyers. The

Tbelact after this eomtiluuon waa adopted ami the Court of Errors and Appeals first came into being the tlx special, judges constituted just half of the court but from an early tune it waa the custom to appoint Dwyers, although the Dy element has always bud mi representation in the court. Among the eminent Dwyers who have held the place may be named William N. Wood, James Bpeer, Garret D. Wall, Amxi Dodd, Caleb £. Green, Robert Green and others. Although the majority of the special judges were Dymen, prominent in various walks of life, and generally men of high character and ability, their presence in the court was always regarded by members of the Bar as an incongruity. When Governor Griggs came in he resolved to take four of these judges irotn the Bar and appointed William L. Dayton, Charles E. UehdncksoD, James H.
