In support of this claim a letter of the President'* ia produced, whetein he note* certain joint operation* of the department of justice and the department of commerce and labor conducted for the purpose of securing evidence against the packer*, these operation* having the executive approval. On the surface it does not appear wherein this implies a guarantee of immunity. In any case the attempt to exploit executive correspondence in a court of jus'ice U a bold one and if it should succeed a new and startling precedent would be established. It Is extremely doubtful, however, that the courts will lend countenance to any such departure.

That Cape May is growing rapidly ie evidenced by the new appropriating ordinance for the support of the resort for the current year. For 1906 there was appropriated $77^26.00. The new budget provides for the appropriation of 9106,480 00 or an increase of G6 per cent. Since last year business has been on the move and the coming to Cape May of large monied interests, and the spending of million* in the improving of the eastern portion of the resort has caused increased expenditure* on the part of the municipality to keep up with the march of private enterprise. The resort's permanent population has increased shout 30 per cent, and the valuation of the real estate has been increased over 30 per cent, by the aeeaors. Ten year* ago the average annual budget was about $56,000DC.
