The death of Judge Acbeson, of Pennsylvania, leaves the Circuit Court for tins district comprised of Judge Dallas, of Pennsylvania, and Judge Grey, of Delaware, and the appointment of a New Jersey jurist to fill the vacancy would give to each State in the Third district a representative on the benc^. That would tie as it should -'be. The promotiou of District Judge William M. banning to the Circuit Judgeship is suggested, and be is eminently worthy of the honor. New Jeisey has had no place in the higher courts ol the U uited States since the death of Justice Joseph Pj_ Bradley, of the Supreme Court, in 1893, who was succeeded by Justice by George Shims, of Pennsylvania, since retired. In the matter • of filling the present vacancy on the Circuit Court bench, the appointment will be made irom some one of the three States forming the circuit, and New Jersey deserves just consideration of the appointing power Doubtless Senators Kean and Dryden will use every effort to secure the appointment of Judge banning, who appears to be the choice of public sentiment in the Slate, although there may be some prominent members of the bar of the State suggested for the honor. At all events, the President should not overlook the opportunity to evenly balance the composition of the Circuit Court of this district

As an appropriation was made by the Legislature to meet the expense of sending the New Jersey division of the National Guard to attend the McClellan memorial unveiling in October, the Legislature, at the extra session in September, can readily pass a bill for the purpose.
