Ci ILES E. HENDRICKSON, JR., Secretary of Committee. R it «t TEW JERSEY'S JUDICIAL SYSTEM IS ANTIQUATED, WHILE I WE HAVE ADVANCED IN MANY OTHER RESPECTS. IT I IS UNNECESSARILY EXPENSIVE BOTH TO THE STATE J ^ AND TO SUITORS. Under our present judicial sv tlem we have, district court judge* in a number of the eountioa. f » In every county we hare one law judge and in some of the counties two law judge*, with many e mrla of sfifferent jurisdiction.. We have six circuit court judges, one chancellor and seven vice chancellors, one chief justice and < ight associate justices of the supreme court, and, in addition, six judge* who, with the chancellor, chief justice and eight associate justices of the supreme court, constitute the court of last resort of the state, that court being composed of sixteen judge*. It was the intention of the framers of our present judicial system that THE JUSTICES OF THE SUPREME COURT SHOULD GO TO EACH COUNTY THREE TIMES IN EACH YEA and try every important case before a jury, whereby suitor* had the benefit of a judge of great experience to try their cases. THESE JUDGES INSPIRED EUCH CONFIDENCE IN THE PEOPLE THAT COMP/ RATIVELY FEW APPEALS WERE TAKEN TO THE HIGHER COURTS AND A LARGE MAJORITY OF THE CASES WERE FINALLY SETTLED BY THE TRIAL IN THE COUNTY. IT IB THEREFORE OF THE HIGHEST IMPORTANCE T*<AT THE JUSTICES OF THE SUPREME COURT SHALL CONTINUE TO PRESIDE IN THE TRIAL OF CASES IN THE COUNTY. The increase of the number '<f appeal* to the court of last resort' ha* made it necessary for the justices of the supreme court to sit for »o much of the time in that court ibat THEY HAVE BEEN UN ABLE FOR THE LAST TWO OR THREE YEARS TO GO DOWN TO THE COUNTIES, AS FORMERLY, and that ha* necessitated the appointment of special circuit judges. The fact that the court of last resortITeompoeed of sixteen judges makes the consideration and 4isi>osition of cases in that court very •low and HAS RESULTED IN THE ACCUMULATION' OF A LARGE LIST OF CAUSES in that court, and they will under the present system constantly increase. Under the proposed amendment the six circuit judges, with a salary of 17,000 each, and the six special judges in the court of last resort, with an annual compensation of about $3,500 each, will bo dispensed with. EACH COUNTY WILL rtAVE. AS NOW, A LAW JUDGE. The present justices of the supreme court and the chancellor and vice chancellors will be justices of the supreme court, and from that body seven judges will be selected to constitute the court,of last resdrt, with no other duty to perform, and WILL THEREBY BE ENABLED TO SIT FOR THE REARING OF CASES THROUGHOUT THE ENTIRE YEAR, except such time as is allowed fm THE DELAY AND EXPENSE WHICH WILL THEREBY BE SAVED TO COUNSEL AND SUITORS ARE APPARENT. The remaining justices of the supreme court will be divided into tvro branches, one branch to hear law cases and the other branch to hear chancery cases, so that the Uw justices can, as formerly, go down to the counties for three terms in each year to try jury cases. Power is given to the supreme court justices to make changes in procedure by which|thoy can transfer, without cost to the suitor, • «se which has been commenced in the wrong court to the proper tribunal and to establish a practice SO SUPPLE' AND EXPEDITIOUS THAT MERE TECHNICALITIES WILL NOT PREVAIL TO DEFEAT THE ENjfe OF-JUSTICE. • Our courts will be enabled to dispose of legal eontro' rales upon their merit* with dispatch, affording ample time for deliberation and fall consideration of the rights of suitors, and the delay, vexation and expense -resulting from technical defenses and the selection of the wrong tribunal will be su auotially removed. This amendment was reported to the legislature after much study and deliberation by a commission consisting of John W. Griggs, Franklin Murphy, B. Van Srckal. Charles L. Corbfti and John E. IJardin. It was without any PARTISAN INFLUENCE and has been approved by two sneoessive legislature* by an almost unanimous vote. No reasonable objection has been or can be urged against it, and its defeat canm^fe only to the benefit of those who can make litigation 30 EXPfNSIVE AND SO INTERMINABLE (hat the ordinary suitor can derive no benefit from the prosecution of a just claim. v EVERY CITIZEN WHO DESIRES TO HAVg JUSTICE EXPEDITIOUSLY ADMINISTERED SHOULD EXERT HIMSELF TO SECURE THE ADOPTION OF THIS AMENDMENT.
