That when any hnsband and-wHe-shail 4iv«-i->it!»V in a slate of separation, withont being divorced, and shall have any minor child or children of the marriage, the chancellor, the supreme court of this state, or any justice of the raid supreme court, upon llie said child or children being broogbl bufoie them npon habeas corpus, shall make an order for the access of the mother to her infant child or children at such times and under inch circumstances as they may «.irect ; and if the said child oe children be within the age of seven years, shall make an order that the said cjiild or children be delivered to and remain in tho custody of the mother until such child or children shall attain inch age, nnless said mother akall be of such character and habits as to
render her an improper guardian for said
child or children.
