BE IT ORDAINED AND ENACTED 1 BY THE INHABITANTS OF THE ' CITY OF CAPE MAY IN CITY 1 COUNCIL ASSEMBLED. AND IT IS i HEREBY ENACTED BY THE AU- I THOR1TY OF THE SAME: i Section 1. That when this ordinance i ■hall have been regularly passed and i shall have taken effect, tbe City Council, or the proper Committee or Com- | mittees thereof, may, without further I order, advertise for bids for the repair < and rebuilding of the Boardwalk on Beach Avenue ; the repair of and ad- i ditiona to City Pavilion Number One; • tbe construction of bouse sewers on i Maryland Avenue between Madison i Avenue and Philadelphia Avenue, a i distance of approximately three bun- : dred feet; ana on New York Avenue ; from Reading Avenue.to Madison Avenue, approximately a distance of six- • teen hundred and seventy-eight feet; 1 and on New York Avenue from Read- > ing Avenue to Trenton Avenue, a distance of approximately six hundred and thirty feet; and on New York Avenue from Pittsburg Avenue to Trenton Avenue, a distance of approxi- i mately six hundred and thirty feet; tbe construction of a sewer from Pa- i vilion Number One to ■ point on Guer- ■ ney Street approximately fcur hundred feet from Beach Avenue, a total distance of approximstely four hundred and seventy-five feet, and tbe construe ion of Arch 's on the Boardwalk on Beacb Avenue, in accordance with the petitions, plans and specifications ■ on file in the office of the City En gineer; which bids shall be received and opened in Common Council of said Oity and the award of the Contract or contracts to tbe lowest responsible : bidder or bidders sbali be made by aaid City Council at such time or < timis as said Council shall determine to make such award or awards ; or aaid Council may, if in tbeir judgment it iB advisable, employ workmen and furnish mateiiala for the construction of i the aaid work or such portion thereof as the.< deem advisable. 8ec. 2. And be it further ordained and enacted that tbe aaid City Council shall, without further or other order or ordinance for that purpose, borrow for the aaid Oity of Cape May the sum of Forty Thousand Dollars and issue Bonds of the City of Cape May therefor, pursuant to the provisions of an act of the Legislature of the State of New Jersey entitled, "An Act to authorize any Oity of this State to raise money, either by temporary loans or by tbe issue or issues of bonds for any sum not exceeding fifteen per centum of the taxable value of the real and personal property rated for asset anient in such city, and to use the same for the purpose of retiring the floating or matured bonded indebtedness, for tbe enlargement and improvement of the public buildings, water works, sewerage system and for other lawful purposes of sucb city." Approved Marcb 22, 1901, (P. L. 1901, page 86) and the various acts amendatory thereof and supplemental thereto. There shall be used from ti e proceeds j of the sale of the said Bonds, for the purpose of taxing up, funding and retiring o rtain floating indebtedness of tbe -City of Cope May, the sum of sixteen tiiou and dollars, as follows, towit: Note duv May fourteenth A. D., 1910, the sum ot Ten Thousand Dollars No e due June eleventh A. D„ 1910, the sum oi Six Thousand Dollars. Tbe minds shall bear date tbe twentieth day of April nineteen hundred and tin and shall draw interest at tne rate of five per centum per annum, payable semi-annually, and aaid bonds shall not be sold for leas than tbeir par or face value. newer* on Maryland and Now York A»enues shall be issued in Short Term Bonds and payable in two years from their date. All monies received from the assessments of adjacent properties for tbi cost of the construct ion of tbe said l ouse sewers shall bi- paid into a fund and preserved intact to discharge aaid short, term sewer bonds at their maturity. Said Long Term Bonds shall be roupon bonds and said Short Term i Bonds shall be registered bonds, witbout coupons I Sec 8. And be it further ordained and enacted that -the mayor is hereby authorized to sign said bond and the City Clerk to attest the tame and to affix the corporate seal of the City thereto and the City Treasurer to countersign the same and sign tbe coupons thereto attached ; and the Finance Com mittee are hereby authorized and directed to prepare said bonds ready for execution by tbe officers of tbe City hereinabove named, and, upon their execution as herein directed, to sell the same or any part thereof for the best price which may be obtained therefor, not less than par thereof, and upon the sale thereof, or any part thereof, and the payment thereof, tbe proceeds of Buch sale or sales shall be applied to defray tbe cost of the said sewers, tbe funding and retiring of the aaid floating indebtedness, the repair and rebuilding of tbe said Boardwalk on Beach Avenue, the repair of and addition to Pavilion NumOne and tbe construction of Arches on tbe Boardwalk on Beach Avenue. Sec. -4. And be it further ordained and enacted that upon tbe oompletion of the house sewer work on Maryland and New York Avenues ordered under the provisions of this ordinance, the coat thereof shall be assessed to the adjacent properties respectively to the amount of tbe benefits conferred upon tbe said properties respectively in accordance with the provisions of the charter of the City of Cape May and existing laws 'governing such city as , to assessments; said assessments shall be made immediately upon the completion of such work and become payable i within three months from the date of such assessments. Sec. 5. And be it further ordained and enacted that upon the issuance of said bonds an amount equal to two per centum per annum shall be paid into the sinking fund to create a sufficient fund to meet such long and abort outstanding bonds at their maturity, and there sball be assessed annually in the said City of Cape May the necessary taxes to pay into the said sinking fund annually the necessary amount and sibo to pay the annual interest on said long and short term bonds. Sec. 6. And be it further ordained and enacted that this ordinance shall take effect immediately upon its pas§Hge and publication. TO MOTHER..
