In an action for fire trespass on the the United States against the Missouri River and Northweetrfn Railroad, the jury tea awarded damages to the Govchantable timber hut also for the destruction of unmerchantable young ( growth: Thia is regarded by Government officials as establishing a very Important 1 precedent. 80 far as is known at the U. 8. Department of Agriculture, it Is the j time that any court has recognised what foresters call the "expectation value" of young growth, has furnishing a 1 basis for the award of damages. The difficulty in the way df such an award in -j the past has been that there waa no way prove to the satisfaction of the courts the money value of the loss suffered. j The award in the South Dakota case the presentation of evidence as q to the cost of work in. reforesting which the Government ia actually doing in the Black Hills. To meet such cases what are known as "yield tables' are being prepared. By the use of these the loss can be shown in terms of the final crop and j the time necessary to produce it. , j Thus, if it is known that ten ftous- f and feet of timber per acre can be cut j in seventy years, it is easy to calcn- j the value of tbe crop when it is ten ( years old by discounting from its value , | when mature.
