At the time of making application for a permit for such purpose, as herein provided, such person, or persons, company or corporation shall deposit with the Borough Clerk the sum of Fifteen Dollars to cover the expenses of repairing and repaying such street, and in case such person or persons, company or corporation shall fail or neglect to make such repairs wjthin the time specified, the said sum so deposited shall be' forfeited to the Borough, and the said Gerk under the direction of the Street Committee is hereby directed to apply said sum to the repair of said street. In case such sum so deposited shall be insufficient for such purposes, then the person or persons, oompany or corporation, so opening up said street, shall also pay the additional amount necessary for repair*. In tke event of such street being put and left in as good conditions as when said work was commenced and to the satisfaction of the Street Committee, the said sum of Fifteen Dollars so deposited shall be returned to the person or persons, company or corporation making the deposit. Section 2. And be it further ordained and enacted that it shall be unlawful for any person or .persons, company or corporation, at any time, to open any street for the above or for any . purpose whatsoever without first hav- . ing obtained a written permit for the' same from the Borough Gerk. t - Section 3.
