I An Ordinance | An Ordinance authorising and emS wring Cape May Light and Power mpany, and its _ successors and asI signs, to erect and maintain poles, and to string, contract, maintain and operate wires and electrical conductors, fixtures and appliances thereon, in, on, j over and along all the streets, avenues, I highways, roads, alleys, lanes, squares . and other public planea of the City of Cape May, for the purpose of conveying electricity and sullying light, heat and power to the citizens of the City of Cape May, and others: Whereas, by an ordinance of the City of Cape May, entitled, "An ordinance to ^authorize the sale of the electric light ^t and franchise of the City of Cape , to Waters B. Miller," approved June 14th, 1886, it was among other things provided that the Electric Light Plant of the City of Cape May, including one fifty horse power engine, about ' four miles of wire, be the same more or leess, poles, pulleys and other equipments, together with the exclusive franchise of furnishing the City of Cape May with electric lights for and during the period of ninety-nine years from the date of the approval of the said ordinance, upon the terms therein stated, should be conveyed to one Waters B. Mllier, his heirs and assigns; and Whereas, by virtue of successive conveyances, the said Cape" May light and Power Company is now the owner of the said Electric' Light Plant, poles, wires, and othe'r machinery and equipment. and is now operating the same: Now, Therefore, The Board of Commissioners of the City of Cape May, do ordain: Section l.-That Cape May Light and Power Company and its successors and assigns, be and the same are hereby authorized and empowered to erect and ' maintain poles, and to string, construct, r maintain and operate wires and electrical conductors, fixtures and appliances, in, on, over and along ali the streets, avenues, highways, roads .alleys, lanes, squares and other public places of the Oily of Cape May, for the purpose of conveying electricity and supplying | light, heat and power to the citizens of | the City of Cape May and others. j Section 2. That all poles which shall j hereafter be erected under this ordi- ! road, alley, lane, square or public place | in the City of Cape May, shall be lo- I cat >nl. placed and erected under the di- j reel ion and supervision of the govern- | ing body of the City of Cape May. or : of the Department of the said City"! having control and jurisdiction of the j streets of said city. . I Provided, however, that no poles shall . be used for lighting the beach front or | boardwalk at any time without the j consent and approval of the governing body of the city. Section 3. That as to those streets. , avenues and roads in the City of Cape May, on which no poles are now erected, a permit shall be obtained from the , governing body of the said City of Cape May. or from the department of said City of Cape May, having control and j jurisdiction of the streets of the said | City, before any poles shall be erected j thereon under this ordinance. Section 4. That the said poles shall - be reasonably straight and properly und | neatly dressed, and shall be located and erected in such manner as in no way to interfere with the safety or convenience of persons traveling on or over the said streets, avenues, highways, roads, alleys, Iane9 or squares. Section 5. That the said Cape May Light and Power Company, and its successors, shall indemnify and save harmless the said Cit^r of Cape May, from and ageinst any and all co9ts, expenses or damages whatsoever, arising out of or by reason of the erection or maintenance of the said poles, wires, conductors, fixtures and appliances, in, on, over and along the said streets, avenues, highways, roads, alleys, lanes, squares and other public places of the City of Cape May. Section 6. That the authorization and consent hereby granted shall continue in full force ad effect for the term of fififfy years from and after the date of the ' final passage of this ordinance. Section 7. That the said Cape May Light and Power Company shall pay ail expenses of the publieation of this ordinance and of all proceedings relating thereto. Section 8 That upon the acceptance of this ordinance by the Oa|>e May Light and Power Company, all rights of the said Company to an exclusive franchise under the said ordinance of the ('it v of Cape Ma v. entitled "An ordinance to authorize ilic sale of the electric light plant and franchise of jhe City of Cape May. to Waters if. Miller" approved June 14th. 1886. to light the City of Cape May for terms and conditions therein stated, shall terminate and come to an end. Section 0. That this ordinance shall take effect upon the Cape May Light and Power Companv filing with the City Clerk of the City of Cape May. its written acceptance of the terms thereof, and upon its paying the expenses of the publication of this ordinance and of the proceedings relating thereto W.
