An Ordinance An Ordinance authorizing and empowering Ctpe May Light and Power Company, and its successore and assign,, to erect and maintain poles, and to string, contract, maintain and operate wires and electrical conductors, fixtures and appliances thereon, in, ou, over and along all the streets, avenues, highways, roads, alleys, lanes, aqua res and other public places of the City of Cape May, Tor the purpose of conveying electricity and supplying light, heat and power to the citizens of the City of Cape May, and others. Whereas, by an ordinance of the City of Cape May, entitled, "An ordinance to | authorize the sale of the electric light £nt and franchise -of the City of Cape ' y, to Waters B. Miller," approved ' June 14th, 1886, it was among other . things provided that the Electric Light | Plant of the City of Cape May, includ- , ing one fifty horse power engine, about four miles of wire, be the same more or leess, poles, pulleys and other equipments, together with the exclusive Iran- i chise of furnishing the City of Cape i May Tvfth electric lights for and during i the period of ninety-nine years from i the date of the approval of the said ordinance, upon the terms therein stated, should be conveyed to one Waters B. Milier, his heirs and assigns; and Whereas, by virtue of successive conveyances, the said Cape May Light and ' Power Company is. now the owner of . the said Electric Light Plant, poles, wires, and other machinery and equip- ' ment, and is now operating the same: Now, Therefore, The Board of Commissioners of the City of Cape May, do ordain: ■•Section 1. That Cape May Light and Power Company and its successors and , assigns, be and the same are hereby ' authorized and empowered to erect and , ' maintain poles, and to string, construct, t maintain and operate wires and electri- - cal conductors, fixtures and appliances, in, on, over and along all the streets, avenues, highways, roads .alleys, lanes, < squares and other public places of the < City of Cape May, for the purpose of ' conveying electricity and supplying 1 light, heat and power to the citizens of * the City of Cape May and others. 1 Section 2. That all poles which shall ' hereafter be erected under this ordinance, on any street, avenue, highway, road, alley, lane, square or public place in the City of Cape May, shall be lo- '• eated, placed and erected under the direction and supervision of the governing body of the City- of Cape May. or of the Department of. the said City I having control and jurisdiction of the , streets of said city. Provided, however, that no poles shall . 1 be used for lighting the beach front "or | ' boardwalk at any time without the i 1 consent and approval of the governing : body of the city. Section 3. That as to those streets, , avenues and roads in the City of Cape i May, on which no poles are now erected, ; 1 a permit shall be obtained from the j 1 governing body of the said City of Cape I] May. or from the department of said | City* of Cape May. having control and , jurisdiction of the streets. o£ the said j - City, before any poles shall lie erected ]« thereon under this ordinance.
