Also issued was a procedural regulation which sets up machinery for protest and amendment of the maximum rent regulations and for adjustments under them. This regulation is for the guidance of landlords and tenants in any petitions or applications they may make, such as for change of the rent as set by the maximum - rent date. According to a release from the OPA, the reduction of rents to new levels will be automatic. “Beginning June 1, as a general principle with, a few exceptions, tenants are to cut their rents hack to what was being charged -on the maximum rent date set for their respective areas. Approval of such a reduction by a landlord is not necessary. No matter whether the tenant pays his rent daily, weekly or monthly, he is to psy only what the same accommodations were bringing on the maximum rent date,” explained the OPA. “Exceptions to this principle are made in the maximum rent regulations for housing accommodations, other than hotels and ning houses, in which proviis made for adjustment in i rent as set by dste

“When the housing accommodations have been changed from unfurnished to furnished, or furnished to unfurnished, or there has been an increase or decrease in the services since the maximum
rent date.
“When the rent charged for the accommodations on the maximum rent date was ‘materially affected by blood, personal or other special relationship betw^gn the landlord and the tenant and as a result was substantially lower’ or ‘substantially higher’ than the rent generally prevailing in the defense-rental area for comparable housing accommodations. “In cases where the housing accommodations have been constructed since the maximum rent date and rented before June 1, 1942, the regulations provide that the first rent charged shall be the rent subject to review by the

"Where the housing accommodations were unoccupied on the maximum rent date, and during the two months imniedistely prior to the maximum rent date, but rented prior, to June 1, 1942, again the rent is to be the first rent charged, subject to review by the area director. “Provision is also made to care for rents affected by seasonal demand. In such cases it is within the jpwers of the area rent director to set different maximum rents for diffeiffht periods of the year,” the OPA continued. Questioning the. authority of local government* to fix maximum rent levels. Mayor Hand, in a reply to Borders, asked: “Has this been done in any areas, and how may it be done? Certainly I have not the authority to do it by order, and I have grave doubts of the validity of an ordinance attempting to regulate this subject under our local
law.
“Some publicity has been given to the fact that thi* is a defense area and I think there is a substantial effort, on the part of brokers and landlords generally, to keep their prices down to the level Indicated. My attention has been called to one or two instances in which this has not been
done.
“Of course, whether or not such a local regulation is valid, is my problem, but I would appreciate receiving the view of your department, particularly, what your experience has been as to the method, adopted by other areas cooperating with your regulations.
