•CITY COMMISSIONERS DISCUSS ZONING WITH REALTY DELEGATION — — • « t Continued from page one) j j delivered before the ^"membership i | booster banquet held at the Biscay-no ! , Motel. - Campbell Scott, Vice President of ] the Technical Advisory Corporation, N'i'W York, was the speaker, and his I ; address was an exposition of the prin- i j ciples of city planning and zoning in|, particular, anil the laws sdfecting the , Mr. Brick urged hef6re_.lhe City r.imraissiopers, the imperative need-, there is-of the city adopting a zoning 1( •iniinance as early as possible, antll. riteii several incidents of depreciation | , in property valuation, already known L in the city, through the absence of j any legal authority to prevent indiscriminate building. ' , • The framing of a zoning ordinance, , lie said, could not bo undertaken with- I out expeft counsel and direction. He ' spoke of a conversation he had hadjt recently, with a distinguished jurist, j : _ who laid great emphasis upon thc!| > fact, that in the framing of an or- " ' ' dinance, it was absolutely necessary i that it should be done in a manner,'] which would stand any test or trial i ■ V in n court of law; for which reason he,; j Mr. Brick, strongly advocated the em- t ployment of expert counsel and aid. | The speaker further contended that j ' ihe people of the city were ready for / n zoning orinance; in addition to the i : Chamber of Commerce, the Kiwanis : 1 i 'lull, the Young Men's Progressive league, and other civic organizations,1: had gone on record supporting the i movement. ' Mayor Joseph G. Champion replied 1 explaining the attitude of the Board of City Commissioners. Personally as an individual taxpayer and citizen he, Ihe Mayor, was in favor of zoning.1 In his official capacity, however, and Ids two colleagues upon the Board of Commissioners, concurred with his, view, he felt that they could not in justice to the taxpayers, undertake to spend the sum of $5,800 without more: definite information, relative to the constitutionality of the ordinance after; it had been passed. The City Commissioners had given/ more thought to the mattefthan perhaps the Board of Realtors gave them credit for. However strongly they might be pursuaded of the advantages to lie gained from zoning the city.: they could not, and would not, be: forced into any action which might in- ; vnlve the city in the future in endless i litigation. Would the expert stand by the constitutionality of the ordinance after it hail been drafted? Were they prepared to defend ,it in a court of law if needs he? The City Commissioners needed
, greater information. With all due respect to Mr. Scott, the expert; after ; all Mr. Scott spoke for Mr. Scott. He: f I had service to sell; but what of the ordinance after it had been adopted? ' P | Mr. Scott would depart, and the re- A sponsibility of defending his work in p I , litigation, would fall upon the city of- C) ' Speaking" on Behalf of the City ° •: CommissiCners, he suggested a joint 11 conference between them and the P Health-Board, with the assistance Of. _ I legal 'counsel. The City Commission- " ' rs would bring legal counsel together p with the City Solicitor, and the Realty " could do the same. Replying to Mayor Champion again^W ' ! Mr. Brick state dthat the work pre-, • I liminary to the passing of the or- : . 1 1 dinance, would provide ample time for i c' ' the consideration of all legal and pos- ! silile difficulties. *. ' A period of at least four months' " 1 would he necessary before presenta- ~ • i tion of an ordinance. Zoning had . 5] ' I proved eminently satisfactory, and 1 *, I advantageous in other cities, which he *- J enumerated, and would be as effective r Ocean Cilv. J* Foltbwing Mr. Brick, Elmer Jack- J? Pearl stated that in reality the or- ' . dinance would be framed by the City • Commissioners, and not by the gjpert. • The mode of procedure would begin by j' I I the appointment of a Zoning Commis- " . I sion. This latter body would pre- • ! pare a tenativc study map of the city. n - 1 cooperation of ,th6 city solicitor, ' | and city engineer, i0uld 1* necessary, . and the final scheme would be sub1 1 mitted to the Board of Commissioners „ . for consideration, emendation and ul- ~ ■ > timately adoption. , Adding to this Mr. Brick said, that 1 t ; when the final plaa was drawn up, it ■ r 1 would be of such a character, as to be i able, to stand any test in a court of £ - The experts were familiar with " »; every phase of the law cffectinig the , subject of zoning. Meanwhile, a cam- - p paign of e<lucation would be carried, on, to prepare the general public for f I the acceptance of the 'ordinance when ; I passed. The City Commissioners, however, , reiterated their attitude, stating they were hot prepared to throw away $5,j SOO of the city's money, unless conf vinced of value received in return. , s The Commissioners were prepared „ to do what they were pursuaded would _ „ lie to the advancement of the city. A c conference would be called between | o the Realty Board anil the Commisr sioners, with legal counsel. In no other way could they arrive at a prop- „ cr solution of the problem. Too much . ' was involved to enter into the matter , a i hurriedly and inadvisedly. f WORK PROGRESSING p Work is progressing on the re- . building of the headquarters of the si Anglers' Club, of Ocean City/and it is expected the house will be ready - within a few weeks, in plenty of time t for the members, most of whom do . not come for the summer season until f about the middle of June or a little later.
