Mrs. Donnelly further statetl that jj ; she rented the store for the purjpose of conducting a hairdressing - iaml manicuring establishment, and
for that reason woultl require ait| I ample supply of hot water through jthe year, antl her rooms heated. J Mr. Spiecker promised to supply (the two necessities, the plaintiff I stated under oath, when the lease ' j was signed. J Since the middle of September,' : however, neither heat nor hot ! water hail been supplied. Under cross-examination by. The only conver-| • sation he had with her relative to t the hot water, was whether it ! ('would be of equal force as during' t previous years. He assured her it i j woultl. The written lease pro-j I duced in court contained all he hadj , promised to supply his tenant. j A long argument ensued between the witness ami plaintiff's attorney i concerning ways and means; through which Mrs. Donnelly could j r be supplied with heat and hotj i water. Mr. Spiecker, however, repeatedly denied he had promised to J t supply these, because the expendif entailed would not be justified 1>y the number of visitors he could1 r expect during the winter.
